Our Commitment
Peace Valley Charter School complies with Title IX, a federal law that protects all students and staff from discrimination and sexual misconduct based on gender, sexual orientation, gender identity, or gender expression.
 

Everyone has the right to learn and work free from:

  • Unequal treatment in educational programs or employment

  • Sexual harassment (including unwelcome sexual advances, stalking, or online harassment)

  • Sexual violence (including sexual assault, dating violence, and domestic violence

Title IX defines sexual harassment as conduct on the basis of sex that satisfies one or more of the following:

  1. Quid Pro Quo Harassment:
    An employee of the school conditioning the provision of an aid, benefit, or service on an individual’s participation in unwelcome sexual conduct.

     

  2. Hostile Environment Harassment:
    Unwelcome conduct, determined by a reasonable person, to be so severe, pervasive, and objectively offensive that it effectively denies a person equal access to the school’s education program or activity.

     

  3. Sexual Misconduct as Defined in Federal Law:

    • Sexual assault as defined in 20 U.S.C. § 1092(f)(6)(A)(v)

    • Dating violence as defined in 34 U.S.C. § 12291(a)(10)

    • Domestic violence as defined in 34 U.S.C. § 12291(a)(8)

    • Stalking as defined in 34 U.S.C. § 12291(a)(30)


Anyone may submit a concern or formal complaint.
To file a Formal Title IX Complaint, complete the Formal Title IX Grievance Form and send it to the Title IX Coordinator. You will receive a response within seven school days.


Process for Resolution

Informal Review

  • An informal complaint must be written and signed by the complainant and must describe the specific acts, conditions, or circumstances alleged to violate Title IX.

  • Anyone with a concern may request an informal meeting with the school principal, unless the principal is the alleged respondent. In that case, the complaint moves directly to Level One – Formal Review.

  • Participation in the informal meeting is optional.

  • If the concern is not resolved through this meeting, the complainant may submit a formal complaint to the Title IX Coordinator.
     

Level One - Formal Review

  • A formal complaint must be written and signed, including a detailed description of the alleged acts, conditions, or circumstances.

  • The complaint is submitted to the Title IX Coordinator/Compliance Officer, who will begin an investigation within 30 calendar days.

  • The school and complainant may agree to resolve the complaint without a formal investigation.

  • After completing the investigation, the Compliance Officer provides a full written report to the Decision Maker.

  • The Decision Maker issues a written determination to the complainant and respondent within 10 days, including notice of the right to appeal to the Board of Trustees and instructions on how to file an appeal.
     

Level Two - Appeal to the Board of Directors

  • Either the complainant or respondent may appeal the Decision Maker’s determination by filing a written notice of appeal with the Board Secretary within 10 calendar days after the end of the Decision Maker’s 10-day review period.

  • The Board will respond, review, or hold a hearing within 30 days of the first regularly scheduled Board meeting after receiving the appeal.

  • The Board’s response will include notice of the right to appeal to the Idaho State Superintendent of Education and instructions on how to file the appeal.
     

Level Three - Appeal to the Idaho State Department of Education

  • Either party may appeal the Board’s decision by submitting a written notice of appeal to the State Superintendent within 20 days of receiving the Board’s written determination.

  • The notice must follow the format required by the Superintendent and include:

    • A concise statement of the original complaint and the portions of the Board’s decision being appealed

    • The relief requested by the complainant or respondent
